Senator Bob Hall of Canton has introduced Senate Bill 80, which would allow Texas to declare federal actions unconstitutional.
Hall has named the bill the Texas Sovereignty Act.
“We are an independent state, except for where the constitution gives the federal government specific authority to do something,” Hall stated.
The proposed bill would establish a bipartisan joint committee to review federal actions. Potential subjects for review include federal laws, agency policies, executive orders, court decisions, and treaties.
If the committee finds an action unconstitutional, it must be confirmed by the Texas Supreme Court, the full legislature, and the governor.
If an action is declared unconstitutional, no Texas funds will be used to enforce it.
The 89th Texas Legislature begins on January 14. The bill will become law immediately if it passes with a two-thirds majority in both chambers.
