Texas Attorney General Ken Paxton has filed a lawsuit against the NCAA, challenging its policy on transgender athletes.
On Sunday, Paxton took legal action against the NCAA, alleging that the organization engaged in deceptive marketing practices by allowing transgender athletes to compete in women’s sports.
According to Fox News, Paxton argues that the NCAA has violated the Texas Trade Practices Act. This act aims to safeguard consumers from deceptive business practices that involve misleading or deceiving them into buying goods or services that do not meet the advertised claims.
In a statement, Paxton accused the organization of engaging in deceptive practices by promoting sporting events as women’s competitions, but then allowing biological males to compete against biological females, which he deemed false and misleading.
According to Paxton, the NCAA is transforming women’s competitions into co-ed competitions in a deceptive manner.
“The safety and well-being of women are intentionally put at risk by the NCAA, as they deceitfully transform women’s competitions into co-ed events,” stated Paxton. He further emphasized, “Viewers anticipate witnessing women playing against fellow women in sports like volleyball, not witnessing biological males impersonating something they are not. College sports should not be a platform for radical ‘gender theory’.”
Paxton is asking the court to issue a permanent injunction that would prevent the NCAA from permitting transgender athletes to participate in women’s sports in Texas. Alternatively, Paxton is requesting that the NCAA be compelled to stop promoting events as “women’s” when they actually involve mixed-sex competitions.
The NCAA issued a response to the lawsuit in a statement provided to Fox News.
According to a statement from the NCAA, college sports play a crucial role in showcasing women’s sports in America. While the organization refrained from commenting on the ongoing litigation, it expressed its commitment to upholding Title IX, making significant investments in women’s sports, and ensuring fair competition in all NCAA championships.
Transgender women currently enjoy protection under Title IX. However, President-elect Donald Trump has expressed his intention to remove these protections once he assumes office.
