Nicois Megale Smith, 40, of Oklahoma City, has been sentenced to 84 months (7 years) in federal prison for illegally having a firearm following a prior felony conviction, according to U.S. Attorney Robert J. Troester. His father, Albert Smith, Jr., 62, had previously received the same term, bringing the pair’s total to 14 years.
On August 16, 2023, a federal grand jury delivered a three-count indictment charging Nicois with two counts of felon in possession of a handgun and Albert with one count of the same offense.
On June 10, 2024, Albert Smith, Jr. pled guilty to being a felon in possession of a handgun in early May 2023. He admitted to possessing a firearm he suspected was stolen.
Two days later, on June 12, 2024, a federal jury convicted Nicois Smith on one of his two charges.
The evidence produced at Nicois’ trial indicated that on May 21, 2023, Oklahoma City Police Department officers investigating a crime near Nicois’ home searched his home and discovered a loaded firearm in the bedroom. The evidence established Nicois’ connection to the firearm.
According to court documents, Nicois and Albert Smith have substantial criminal backgrounds.
Nicois Smith has past convictions in Oklahoma County District Court, including:
- Possession of a controlled dangerous substance with intent to distribute and carrying a weapon.
- Four counts of burglary and possession of cocaine with intent to distribute.

Albert Smith, Jr. has past felony convictions in Oklahoma County District Court, including:
- Larceny of merchandise from a retailer.
- Assault and battery with a dangerous weapon.
- Possession of cocaine base.
- First-degree arson.
- Assault and battery with a dangerous weapon.
On March 24, 2025, U.S. District Judge Joe Heaton sentenced Nicois Smith to 84 months in federal prison, followed by three years of supervised release. On October 31, 2024, Albert Smith, Jr. was sentenced to the same term. When issuing the punishments, the court emphasized the offenders’ long criminal history.
