“This mother did everything she could to escape from a violent and controlling partner, but tragically lost her life. The only fair outcome is for him to spend the rest of his days behind bars,” stated Kim Ogg, the Harris County District Attorney.
Chacon had temporary custody of Gutierrez’s youngest child, who was just 6 months old. The baby resided with Chacon and his new girlfriend at an apartment complex on Red Bluff. This is where Gutierrez would visit her child while Chacon was at work, usually around 9 a.m.
Gutierrez’s cries for help prompted concerned neighbors to dial 911.
Chacon escaped to Mexico, but eventually made the decision to come back and surrendered himself at the border between Texas and Mexico.
Chacon was found guilty of committing the crime of capital murder and received a life imprisonment sentence without the chance of parole.
According to authorities, there were two cases of domestic disturbance involving Gutierrez and Chacon in Pasadena. Gutierrez reached out to the police twice in September. Although an investigator was assigned to the case, no charges were filed against Chacon.
According to Pasadena Police Sgt. Raul Granados, there had been a few incidents in the past few weeks leading up to Gutierrez’s death. He mentioned that these incidents were still being investigated and charges had not been filed yet. Sadly, we find ourselves here today dealing with this tragic situation. It is a heartbreaking situation for everyone involved, particularly for the woman who lost her life.
Chacon’s criminal history reveals a troubling pattern of domestic violence that dates back to 2012. During that time, he faced allegations of physically assaulting his former common-law wife, including accusations of punching her.
In 2017, court documents revealed that the woman claimed Chacon had punched her in the face and placed her in a chokehold, causing her to almost lose consciousness. The victim identified Chacon as her common-law husband and stated that he had taken her phone to prevent her from seeking help and had also prevented her from leaving. Shockingly, this was not the only instance where his ex-wife accused him of attempting to end her life. Court documents further indicated that Chacon had been charged with felony assault of a family member and impeding breathing. However, he was ultimately allowed to plead guilty to a class A misdemeanor.
In December 2012, Chacon entered a no contest plea to another charge of misdemeanor assault of a family member. He had previously been charged with the same offense in March 2012, but that case was ultimately dismissed.
