Ohio Attorney General Dave Yost has filed a lawsuit against Burke Décor, a Youngstown-area retailer specializing in luxury home décor, after receiving more than 350 complaints from customers who reported paying for furnishings that never arrived. The expected damages are in excess of $380,000.
Yost filed the claim in Mahoning County Common Pleas Court, hoping to hold the company and its owner, Erin Burke, accountable and obtain recompense for misled customers. “Consumers paid for high-end furnishings but ended up with only frustration,” according to Yost. “My office gave this company the opportunity to make this right, but empty promises don’t fill homes.”
Burke Décor has two physical stores in Boardman, Ohio, and Los Angeles, California, as well as an outlet in Youngstown. BurkeDecor.com is also a website where the company sells home goods.
Following an increase in consumer complaints about non-delivery, slow delivery, and issues receiving refunds, the Ohio Attorney General’s Office initiated an investigation into the company last year. Despite Burke Décor’s initial cooperation in resolving consumer issues, they have yet to handle 256 complaints.
Yost’s action seeks recompense for victims, injunctive remedies to prohibit future misleading practices, and civil penalties.
