Appeal of man convicted of rape not considered by Ohio Supreme Court

According to WKBN, a rape case involving a Hubbard man who is currently serving 30 years to life will not be heard by the Supreme Court of Ohio as they have declined to hear the appeal.

According to a news release from the Trumbull County Prosecutor’s Office, 35-year-old Kenneth Nitso is currently serving his sentence at Belmont Correctional Institution for committing sexual acts against a minor under the age of 13 between May 2016 and May 2021.

According to the statement, Judge Andrew D. Logan’s court in Ohio’s 11th District has rejected his appeal for both conviction and sentence.

Nitso argued that the jury was not adequately instructed on the potential unreliability of the evidence, which revolved around the admittance of a polygraph test. The appeal emphasized the need for a clear and comprehensive understanding of the evidence presented in court.
